Our Work Process
Step 1: Trade Mark Search
Before applying, we conduct a comprehensive trade mark search to confirm that your proposed mark is unique and not already registered.
Complete our trade mark search form
Results available within 7–14 working days
Cost: R2,000.00
Outcome:
✅ No similar marks found – proceed to Step 2.
⚠️ Confusingly similar marks found – we advise you on the best options before proceeding.
Step 2: Trade Mark Application
Once your trade mark search is successful, we file your application with the Companies and Intellectual Property Commission (CIPC).
Required documents: Power of Attorney (POA) & FICA documents
Filing Fees:
1st Mark, 1st Class – R4,000.00
1st Mark, 2nd Class – R3,500.00
2nd Mark, 1st Class – R3,500.00
2nd Mark, 2nd Class – R3,000.00
Within 7–12 months, we receive an Examination Report from the Registrar.
Possible outcomes:
✅ Unconditional acceptance – proceed to Step 4.
📝 Conditional acceptance – we comply with registrar’s conditions (R4,000.00 per mark per class).
⚠️ Provisional refusal – we advise on next legal options (additional costs may apply).
Step 3: Examination
Our attorneys liaise with the Registrar of Trade Marks throughout the examination process, ensuring all legal requirements are met and that your application moves efficiently toward publication.
Step 4: Opposition
Once accepted, your trade mark is published in the Trade Mark Journal for three months to allow for any objections.
Outcomes:
✅ No opposition received – proceed to certification.
⚠️ Opposition received – we represent you and provide strategic legal advice on resolving the dispute (additional fees apply).
Step 5: Certificate of Grant
After successful publication and no opposition, we request your Certificate of Grant from the Trade Marks Office.
We verify and request corrections (if necessary)
We courier the original certificate directly to you
Cost: R1,200.00 per mark per class
Your trade mark is now officially registered and protected under South African law.
